12.29.1999 64ZINE CLAIMED TO BE ANTI-TC... BY ZODI (TC)
Seems that we have atleast one unhappy reader, Zodi, who didnt like our coverage of the The Corporation dupes and corrupt dumps back in November. Later you'll be able to read a log of a coversation between Zodi and I yesterday.

But before I let you read the log I'd like to state that 64zine is in no way against The Corporation, but because they managed to get both screwed dumps and dupes in one month, I felt that I had to bitch about it. Others managed to screw up too, such as Menace and their releases of Nuclear Strike and Supercross 2k. According to Zodi I didnt bitch enough about those dumps as I did when they duped Rainbow6 and Chopper Attack and screwed up Donkey Kong 64 and Resident Evil 2. Menace saw their error right after they had distributed the release and managed to come up with a fix faster than lightning. The Corporation had to redump and release Supercross 2k though.

Protest Design's arkanoid clone, Dexanoid, was finally released on December 20th. It's very well made although I dont like the game itself much, too different from the original and too large gfx, I'm not blind, no really :)

BUNG LOOSE LAWSUIT
You've probably all read it on Dextrose, but I decided to post it anyway. It's still unknown if Bung actually will stop sending their stuff to the US, but why not vist www.upstategames.com and buy a bung copier while they're still in stock.

U.S. Federal Court Awards Judgment to Nintendo Against Hong Kong Manufacturer of Video Game Copier Devices December 23, 1999 8:01 AM EST LOS ANGELES--(BUSINESS WIRE)--Dec. 23, 1999-- A U.S. Federal Court has entered judgment on behalf of Nintendo of America Inc. against Bung Enterprises Ltd., the Hong Kong manufacturer, and a U.S. distributor of devices designed to make and play unauthorized copies of Nintendo(R) 64 and Game Boy(R) software.

The court awarded Nintendo more than $7 million in damages plus interest and issued a permanent injunction that prevents Bung from marketing or selling any device that has the capability of copying Nintendo's copyrighted or trademarked works. The injunction extends to the United States, Canada, Mexico and the countries of Central and South America and covers both traditional and Internet commerce. The ruling resolves litigation that had been brought by Nintendo against Bung.

Bung products include the Game Doctor, which is designed to operate with the Super Nintendo Entertainment System(R); the Doctor V64, V64 Jr. and Doctor 512, which operates with the N64; and the Doctor GB Xchanger and Doctor GB Card (collectively the "Doctor GB System"), which are designed to operate with the Game Boy. Each of the products permits either the unlawful copying of Nintendo software from the original cartridge format to the hard drive of a personal computer or to an Internet web site for worldwide distribution. These products infringe Nintendo's copyrights, trademarks and patents, the Court ruled.

The Court's judgment against Bung comes after Bung's repeated abuses of the discovery process and disregard for the Court's discovery orders. This conduct led the judge to conclude in the final hearing in this matter that "Bung has not proceeded . . . in a good faith manner in this litigation."

Nintendo's General Counsel, Richard Flamm, commented: "Throughout the litigation Bung demonstrated nothing but contempt for the American judicial system and continued to develop and market products that were designed to permit the pirating of video game software of Nintendo and its third party publishers. We are very pleased the court has resoundingly condemned Bung's conduct and confirmed the infringing nature of Bung's products."

The action against Bung is part of Nintendo's continuing war against video game piracy. Nintendo has filed hundreds of lawsuits against video game counterfeiters, winning a number of significant victories worldwide. The production and sale of counterfeit video game products cost Nintendo, its publishers and developers an estimated $750 million in sales worldwide last year.

CRAZY NATION NUCLEAR STRIKE (+4) TRAINER

November updates (except 11.30.99) moved to archive.



11.30.1999 END OF MONTH
November is over and it's been a month with quite a few nice releases, but also a month with too many corrupt releases and dupes as well as a few delayed games, Top Gear Rally 2 which now is up for a January release (I think), hrmmmf wonder why they choose to take a pass on the christmas sales, and Nuclear Strike which slipped to December.

The Nintendo64 scene isnt what it used to be, cracks arent comming as they used to and Crazy Nation is a bit on the downside with only a few trainers this month. The scene is really lacking new demos, although we did get a new demo yesterday from Protest Design. It's sad that so few groups care about the N64, since it actually IS the last *REAL* videogame console (real videogame machines use cartridges).

Anyways I hope next month will bring atleast a few interesting games and maybe a DK "save fix" as announced and then totally forgotten (LaC?) or a crack for the full version of Jet Force Gemini and that The Corporation will stop trying to get every release, which sometimes results in corrupt dumps because everything has to be done so fast and "they" dont care to test their dump. Sorry Zodi and the rest of the TC crew, but thats how I feel... quality, not quantity.
